Member Hub Terms of Use

Effective Date: January 24, 2019

The American College of Cardiology ("ACC") is providing the Member Hub for use by ACC members for the exchange of views in matters of professional interest. By subscribing to, accessing, utilizing, or participating in the Member Hub, you agree to strictly adhere to the terms of use set forth below. Please be aware that these terms constitute a binding legal agreement between you and the ACC outlining your legal rights, obligations, and remedies arising from your use of the ACC Member Hub. You agree you are responsible for your use of the ACC Member Hub, and hereby release ACC from any consequences or liability arising or resulting from your use of the ACC Member Hub. These terms of use may be updated and modified from time to time, with such modifications effective upon their posting to the Member Hub; your continued use of the Member Hub constitutes your agreement to any such modified terms of use.

ACC is not responsible for, and does not necessarily endorse, support, sanction, encourage, verify, or agree with the comments, opinions, or statements posted on the Member Hub. ACC does not make any warranties with respect to any of the comments or opinions included on the Member Hub. Any information or material placed on the Member Hub, including advice and opinions, are the views and responsibility of those who post the statements, and do not represent the views of ACC. Nothing in the Member Hub is intended to constitute medical or other professional advice.

  1. Rules of Conduct

    1. Do Not Post:

      1. Any message, data, information, text or other material that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, harassing, harmful, invasive of privacy or publicity rights, abusive, inflammatory, threatening, offensive, vulgar or otherwise injurious to third parties, or that would constitute or encourage a criminal offense, create any liability or violate any local, state, national, or international law or regulation, or that otherwise violate the ACC Terms of Service, Registered User Agreement, or Privacy Policy.
      2. Any copyrighted material unless the copyright is owned by you or you have consent from the owner of the copyrighted material.
      3. Any communications leading or related to, or any information that might be construed as price fixing, a boycott, an illegal restraint of free trade or any other antitrust violation; no messages should include information relating to salaries, pricing, profits or costs.
      4. Any harmful content including without limitation, viruses, Trojan horses, worms, time bombs, zombies, cancel bots, or any other computer programming routines that may damage, interfere with, surreptitiously intercept or expropriate any system, program, data or personal information.
      5. Political messages that advocate a particular viewpoint, including links to articles and editorial pieces, unless they relate to a legal issue and the need to place it in context
      6. Advertisements of products or services, or commercial messages, including, but not limited to, messages offering or seeking any kind of business relationship (including employment).

    2. Follow the Following Member Hub Etiquette:

      1. Do not challenge or attack other members.
      2. Post your messages to the most relevant thread of conversation.
      3. Include your name and location in messages.

  2. Content. By posting content, you represent that you have proper right and authorization to use the information or content you upload or post, and you automatically grant (or warrant that the owner of such materials has expressly granted) to the ACC a license to use the content per the terms and conditions contained in the ACC Terms of Service.

  3. Responsibility for Content. ACC does not intend to actively monitor the messages and content posted on the Member Hub. ACC does not warrant the accuracy, completeness or usefulness of any information provided on the Member Hub. ACC neither endorses nor is responsible or liable for the contents, accuracy or reliability of any Web sites linked in any posting, and use thereof is solely at your own risk. The messages express the views of the authors, and are not necessarily the views of the ACC. Anyone who believes that a posted message is objectionable is encouraged to immediately notify the Member Hub Administrator. Under no circumstances will ACC be held liable for any damages or loss resulting from your reliance on any content posted on the Member Hub.

  4. Confidentiality. You are hereby placed on notice that there are no facilities provided by this system for sending or receiving confidential messages and, notwithstanding that a message on this system may be marked as confidential, it may be read by others for whom it was not intended.

  5. ACC Rights. ACC has the right (but not the obligation) in its sole discretion to refuse, edit or delete any content that is available on the Member Hub at any time and for any reason and to deny any person access to the ACC Member Hub.

  6. Indemnification. You agree to indemnify ACC and its affiliates, employees, agents, and representatives, and to defend and hold each of them harmless, from any and all claims and liabilities (including attorneys' fees) which may arise from your posts to the Member Hub, from your unauthorized use of material obtained through the Member Hub, or from your breach of these Terms of Use, or from any such acts through your use of the Member Hub.

  7. DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY. YOU ACKNOWLEDGE THAT YOU ARE USING THE MEMBER HUB AT YOUR OWN RISK. THE MEMBER HUB IS PROVIDED "AS IS", AND ACC HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, TITLE, MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY THE MEMBER HUB. ACC DOES NOT REPRESENT OR WARRANT THAT ACCESS TO THE MEMBER HUB WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED ON THE MEMBER HUB. ACC SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ALLEGEDLY SUSTAINED ARISING OUT OF THE MEMBER HUB OR THESE TERMS OF USE.

  8. Miscellaneous. These Terms of Use supplement the ACC Privacy Policy and Terms of Service applicable to the use of any ACC websites and online services, which are incorporated into these Terms of Use by this reference. If any provision of these Terms of Use shall be found unenforceable, that provision shall be severed and shall not affect the validity and enforceability of any remaining provisions.
